Deferred Action for Childhood Arrivals

DACA: Deferred Action for Childhood Arrivals

DACA permits certain individuals who were brought to the United States as children to obtain work authorization and protection from removal action for a period of time.

To be eligible for DACA, you must meet the following requirements:
  1. You were under the age of 31 on June 15, 2012
  2. You came to the United States prior to June 15, 2007 when you were under the age of 16
  3. You have continuously resided in the United States since June 15, 2007, up to the present time
  4. You were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS
  5. You had no lawful status on June 15, 2012
  6. You are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  7. You have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.
Certain criminal convictions that occurred following your initial grant of DACA may impact your eligibility to renew your DACA and can have severe immigration consequences, including the denial of your DACA application and being placed in removal proceedings. If you have been arrested since receiving DACA, contact us to speak with an experienced Immigration Attorney prior to filing your DACA application.

In addition, over the past several years, there have been many changes to the DACA program.

Contact us to speak with an Attorney at Law MJ Kim LLC to determine whether you are eligible to file an initial application to obtain DACA status in the United States, or whether you are eligible to renew your DACA application.
