About This Case

EK entered the United States in the 1970s on a J-1 visa to complete a medical training program in the United States. Under the J-1 visa, EK was subject to a home residency requirement which prevented EK from obtaining his green card or obtaining another visa without first spending two full years in his home country. EK completed his medical residency program, married a US citizen, and attempted to file various petitions to obtain a waiver of the two-year home residency requirement while living in the United States, but his applications were continuously denied.
