About This Case

EK entered the United States in the late 1990s without inspection. Even though EK was living in the United States for over 20 years, EK was never able to obtain permanent residency. EK now had two U.S. citizen children who over 21 years old who were able to sponsor her for a green card, but EK was ineligible because she had entered the United States without inspection.

Attorney Moonjung Jenny Kim determined that EK was eligible to apply for military parole-in-place because one of her children was serving in the U.S. military. If granted, USCIS would issue EK an entry document allowing her to apply to adjust her status in the United States. Attorney Moonjung Jenny Kim prepared and filed EK’s request for military parole-in-place with supporting documentation to show that EK merited an exercise of discretion. EK’s application was approved by USCIS. EK then filed her application to adjust status and she became a green card holder.
